Achieving finality

Finality may be achieved in a formal and legally-binding sense:

  • in the case of employees by Compromise Agreements
  • in the case of students by contractually binding agreements.  HEIs may wish to provide the same sum for a student to obtain legal advice on the wording of the agreement as would be expected in an employment case.

Mediation can be helpful in creating final binding agreements which preserve working relationships and allow students to continue and complete their courses and employees to make normal progress in their careers.
